3.1 Eligibility

You must be at least 18 years of age to create an account or place an order on Kowsary. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate and truthful.

3.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at hello@kowsary.com of any unauthorised use of your account.
• We are not liable for any loss resulting from unauthorised use of your account due to your failure to keep credentials secure.
• Each customer may maintain only one account. Creating multiple accounts may result in suspension.

3.3 Social Login (Google & Facebook)

• You may sign in using your existing Google or Facebook account. By doing so, you authorise us to receive your name and email address from that provider.
• Your use of Google OAuth is also subject to Google's Terms of Service. Your use of Facebook Login is also subject to Meta's Terms of Service.
• We receive only the data described in our Privacy Policy. We do not access your contacts, posts, photos, or other social data.
• You may revoke our access to your social account at any time via your Google or Facebook account settings without deleting your Kowsary account.

3.4 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 24 months, with reasonable prior notice where possible.

• All product descriptions, images, and pricing are provided in good faith and are subject to change without notice.
• Product photographs are representative. Actual colours and textures may vary slightly due to the handcrafted nature of our items and screen calibration differences.
• All prices are listed in Bangladeshi Taka (BDT) and include applicable taxes unless otherwise stated.
• We reserve the right to correct pricing errors at any time. If an order is placed at an incorrect price, we will contact you before processing.
• Product availability is not guaranteed. If an item becomes unavailable after your order is placed, we will notify you and offer an alternative, credit, or full refund.
• We do not accept orders for delivery outside Bangladesh at this time.

5.1 Order Confirmation

An order is confirmed when you receive a confirmation email from us. This email constitutes our acceptance of your order and creates a binding contract between you and Kowsary. We reserve the right to cancel any order prior to despatch for reasons including (but not limited to) pricing errors, stock unavailability, or suspected fraud.

5.2 Accepted Payment Methods

• Mobile banking: bKash, Nagad, Rocket
• Credit / debit cards (Visa, Mastercard) via SSL Commerz or similar licensed gateways
• Cash on delivery (available in selected areas)

5.3 Payment Security

All online payments are processed by licensed third-party payment gateways. Kowsary does not store your card number, CVV, or full mobile banking credentials. All payment transmissions are encrypted via SSL/TLS.

5.4 Order Cancellation by Customer

You may cancel an order within 2 hours of placement by contacting us at hello@kowsary.com, provided the order has not yet been dispatched. Once an order is shipped, it cannot be cancelled — please refer to our Returns policy instead.

• We deliver across Bangladesh using Pathao Courier and other logistics partners.
• Inside Dhaka: Estimated delivery within 2–3 business days after dispatch.
• Outside Dhaka (nationwide): Estimated delivery within 5–7 business days after dispatch.
• Delivery timeframes are estimates, not guarantees. Delays may occur due to force majeure events, national holidays, strikes, or logistics disruptions beyond our control.
• Shipping charges, if any, will be clearly displayed at checkout before you confirm your order.
• Risk of loss and title for items pass to you upon delivery to the address specified in your order.
• If your delivery is significantly delayed, please contact us at hello@kowsary.com and we will investigate with our courier partner.

7.1 Eligibility for Returns

• Return requests must be submitted within 7 days of the delivery date.
• Items must be unused, unwashed, and in their original condition with all tags attached.
• Customised or personalised items cannot be returned unless they are defective.
• Sale items are eligible for exchange only, not refunds, unless defective.

7.2 How to Initiate a Return

Contact us at hello@kowsary.com or via our contact form with your order number, the item(s) you wish to return, and the reason for return. We will respond within 2 business days with return instructions.

7.3 Refund Process

• Once we receive and inspect the returned item, we will notify you of the approval or rejection of your refund.
• Approved refunds will be processed within 7–10 business days to your original payment method.
• Return shipping costs are borne by the customer unless the return is due to our error or a defective product.

7.4 Defective or Incorrect Items

If you receive a defective, damaged, or incorrect item, contact us within 48 hours of delivery with photographs. We will arrange a replacement or full refund at no additional cost to you, including return shipping.

All content on the Kowsary website — including but not limited to the brand name, logo, product photographs, written descriptions, design elements, graphics, and software — is the exclusive property of Kowsary or our licensors and is protected under applicable Bangladesh and international intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
• You may not use our brand name, logo, or product images for any commercial purpose without authorisation.
• Limited personal, non-commercial use of website content is permitted provided you do not remove any proprietary notices.

By using our platform, you agree not to:

• Provide false, misleading, or fraudulent information during registration, checkout, or communications.
• Use our platform to conduct any illegal activity under Bangladesh law.
• Attempt to gain unauthorised access to our systems, databases, or other customers' accounts.
• Use automated scripts, bots, or scrapers to extract data from our website.
• Place orders with no intention to pay or with fraudulent payment methods.
• Post defamatory, abusive, or misleading product reviews.
• Resell Kowsary products on third-party platforms without our prior written consent.
• Infringe on any third-party intellectual property rights in any content you submit.

Violations may result in immediate account suspension, order cancellation, and/or reporting to relevant Bangladesh law enforcement authorities.

Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Bangladesh law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the website will be uninterrupted, error-free, or free of viruses.
• We do not guarantee that product descriptions are free of typographical errors.
• We are not responsible for third-party websites linked from our platform.

To the maximum extent permitted by applicable law, Kowsary shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) our services.
• Any loss of profits, revenue, data, or goodwill.
• Delays, losses, or damages caused by our courier partners or payment processors.
• Any loss or damage resulting from unauthorised access to your account due to your failure to maintain secure credentials.

In any event, our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under Bangladesh law, including the Consumer Rights Protection Act, 2009.

You agree to indemnify, defend, and hold harmless Kowsary and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of our website or services in an unlawful manner.
• Any content you submit to our platform that infringes third-party rights.
• Your provision of false or fraudulent information.

We reserve the right to modify these Terms at any time to reflect changes in our business practices, applicable law, or platform features. Material changes will be communicated by:

• Updating the "Effective Date" at the top of this page.
• Sending a notification to registered customers via email.
• Displaying a prominent banner on our website for at least 14 days before changes take effect.

Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh, including but not limited to:

• The Consumer Rights Protection Act, 2009
• The Contract Act, 1872
• The Digital Security Act, 2018
• The ICT Act, 2006 (as amended)
• The E-Commerce Policy, 2021 (Cabinet Division, Government of Bangladesh)

Dispute Resolution

In the event of any dispute arising from these Terms or your use of our services:

• Amicable Resolution: We encourage you to contact us first at hello@kowsary.com. We aim to resolve all disputes within 14 business days through direct communication.
• Consumer Protection: You have the right to lodge a complaint with the Directorate of National Consumer Rights Protection (DNCRP), Bangladesh.
• Jurisdiction: If a dispute cannot be resolved amicably, both parties submit to the exclusive jurisdiction of the competent courts of Dhaka, Bangladesh.
